Lindsay has been in rehab for almost a month now, and every time she extends her stay we get a little more hopeful that she'll finally stay clean. That being said, we've just gotten more details on the car accident that sent LL to Promises in the first place; apparently she had cocaine as well as twice the legal limit of alcohol in her bloodstream. LL was very clearly in violation of the law in more ways than one, so we want to know - do you think Lindsay should go to jail?

1hell yes she should go to jail, She could have killed someone! Plus I heard she's staying in rehab b/c she likes her personal trainer...not exactly taking it seriously, besides if she's actually restricted and watched all the time and not allowed little "outings" here and there she will finally take all this seriously

4Lyndsay needs something to really scare her out of this lifestyle. (I'm not sure she's really recovering in rehab since she hasn't even really stayed there too much.) Young Hollywood is destructing they all need to take responsibility for their actions and turn their lives around.
5I agree Pink!! Lets see twice the legal drinking limit (sadly even worse than Paris) and drug possession & you're under 21!! homegirl - you have broken the law in more ways than 1!! But with the Los Angeles justice system who knows! House arrest maybe? Or House Arrest at Promises and more time there...
6Not justifying either one's behavior, but Paris did NOT go to jail for a DUI, she went for repeatedly violating probation. Lindsday had not had a prior conviction or been placed on probation, so it should be handled the same as any first time offense, unless she gets stacked charges because of the DUI and illegal substance abuse.
I think she should have to have drug testing on probation to show that she isn't using any longer.

8I totally agree, tiabia. I love, LOVE Linds, but seriously -- if she was just some average woman livin' in the U.S. and committed this crime, you know her butt would be in prison. Or at least some type of juvenile center. I have great hopes for her that she'll turn out wonderful... but paying your dues sometimes makes you see the light in stupidity.
I mean -- at twice the alcohol level and COKE in her system (which is -- hello -- illegal!) she could have killed someone! She's very blessed her situation didn't end up worse than it could have. She's lucky to be alive and maybe some time in the cellar will allow her to realize that.
9I support her...she's still really young, unlike paris, and should be given another chance to see if rehab worked. and maybe house arrest. but jail? she's 20 and can still be taught to be better constructively.

12I am a Lindsay fan, (she's a good actress and beautiful), but I don't believe rehab is actually going to help her. She'll probably be back to partying. That being said, I think she should get a pass, but if she messes up again, she should do some time. Maybe she should have to do community service or something. She should be given a chance when she gets out of rehab to prove that she won't be reckless and endanger others.
13Anybody who puts others at risk to that severity by drinking and driving needs to go to jail. Period. That kind of behavior is completely inexcusable, especially when you consider how many innocent people are killed every year by drunk drivers.

22She should go to jail, by all means. She had how many car accident's before this? How many of them was she actually drunk for? She needs to do the time, just like Paris (kind of) did. These out of control need to realize that no one is untouchable or invinsible.
23Yeah, I don't agree with people saying because she's only 20 she should get a break. Honestly, I think because of that she should get a harsher punishment. Maybe then she will actually have a future without drugs, alcohol or just life in general!

29kickinthecherries - you are right, paris was sent to jail for probation violation..what I was trying to say was that when she was initially caught DUI Paris was still less than Lindsay..
I agree if no other violations are present for Lindsay then initial offense..but then like tshelley said..any other woman in the US who would have done this would be sent to jail Yesterday..so..those are my 2 cents..
The parents that Lindsay has are no form of support for her whatsoever..this is such a shame!
30Also, I think if she stays in a rehab facility that's not a spa you can stroll in and out of, it counts towards your sentencing and also impacts the length of the sentence given. If you're working hard to change and seem remorseful, they are more lenient.

33To clarify, I am not sure what the punishment is for a DUI with a controlled substance and alcohol, but if it is usually jail time then she should definitely have to do it. She is no different than the rest of us.
34i have maintained since she checked herself into rehab that it was only as a preemptive measure to prevent her from going to jail b/c her toxicology report was going to say something really bad.
extended stay or not, i think if she was really serious about it she wouldn't be leaving for gym time or to hit the beach for a day...
35I hope she comes out rebilitated, and then if they want to bring on the charges, bring em on. She should be mature and sober enough to handle it once out of rehab.
36I disagree that any other woman would've been sent to jail on a first offense. Quite often, DUIs result in a suspended license. Jail time is for repeat offenders or those who violate their probation terms.

47And I'm sorry, I stupidly sampled with drugs and drank waaay too much in my younger years but I never got behind the wheel of a car or ever put anyone's life in jeopardy (other than my own) like she did, sooooooo time to face the music Lindsay. It is a shame her parents weren't more "parental".
48trinitcip - LL is only like 4-5 years younger than Paris. That's not that big of a difference. I can assure you that at almost 21, I knew enough not to drive my car under the influence of coke and alcohol. That's not an excuse.
49I'd like to see the statistics on DUI/non-fatal hit and run involving inanimate objects and how the conviction turns out.
Then I'll decide if I change my mind on the whole thing. Because I still don't think the majority of non-famous people would go to jail for it, I think a hefty probation would come first.
