11About the Oprah thing. She is responsible for providing a safe environment for the audience of her show and avoiding a rush to seats is crucial. A rush is to be expected (prior knowledge) and she should have had staff and measures in place to prevent it. She also owns the studio, so she's liable as the property owner, not so much as the host of the show.
It's pretty much open and shut. She is VERY lucky the lady is not asking for a WHOLE lot more money. Remember the Who concert stampede that killed a lot of people in Cincinnati? They put in place extremely stringent liability laws after that about maintaining crowd control. Legally speaking (I'm an attorney), Oprah will be smart to settle this out of court.

15About Oprah - our country has become very litigious, which is unfortunate. But, c'mon Pop - if someone falls down in your house, you might be sued. Someone fell in Oprah's studio, so legally, she can be held responsible. What's surprising here?

If a kid can come into my yard, egg my house, trip and skin his knee on my sprinkler system then sue me and win, you shouldn't be suprised. oh, and for all of you out there who have parties at your house, atleast in the great state of virginia, if someone leaves your house and gets in an drunken accident, or even gets a dui, you can be sued for allowing them to get drunk and leave your house.

26The people who caused the woman's injury should be liable. If I stab someone in your house, is it your fault? Terrible analogy but you get the point. I'm also sure that there are liability things one must sign before getting a ticket.

28If you want to read the complaint in the Oprah case, it's on the Smoking Gun website. Ethiopian Princess, it's not the same thing. Stabbing someone in my house would be a criminal case, and the State would prosecute you. The person you stabbed might be able to sue me under my homeowner's policy, but they would have to prove I had reasonable knowledge of the possibility that you might stab someone (like I knew in advance you were a knife wielding serial killer! LOL) I couldn't sue you.
This a civil lawsuit for damages resulting from unsafe conditions in a public venue which resulted in injury. Your house isn't a public venue. Owner of public venues must take reasonable steps to ensure the safety of the public. The complaint sets out what went wrong pretty well. A crowd was allowed to gather, become restless and pushy, and when the doors were opened, the agitated crowd was told to seat themselves (the same "festival" seating that resulted in the Who concert deaths). Oprah should have known that the audience would be excited and jockeying for seats, and provided adequate security.
Again, she's being sued because she's the property owner, not really because she's the host of a show.
