TMZ has learned Britney Spears has lost physical custody of her kids.
L.A. County Superior Court Judge Scott Gordon issued an order today stating that Kevin Federline, the boys' father, "is to retain physical custody of the minor children on Wednesday, October 3, 2007 at 12:00 PM until further order of the court."

Tony Barretto, a former bodyguard for Britney Spears, filed a declaration in the Britney Spears/Kevin Federline custody battle which alleges "nudity, drug use and safety issues post-rehab."
Gloria Allred, Barretto's attorney, said in a press conference today that Brit's former hired muscle was prepared to testify under oath today, but that neither the court nor Britney's attorneys chose to cross-examine him. She said his declaration went "unrefuted and unchallenged."

Britney Spears will share equal custody of her sons with Kevin Federline until 2010, after a judge extended an agreement allowing her to see the kids during her Circus world tour.The superstar singer negotiated a deal with ex-husband Federline earlier this year, which allowed her to take her two sons, Sean Preston and Jayden James, around the world while she undertakes her latest global trek.Federline - who has primary custody of the children - traveled with Spears` entourage, and the deal worked out so well for all parties that Spears was granted extra time with her kids, splitting custody equally with her ex.The deal was initially agreed until the end of August, but lawyers for both parents have agreed to extend the order until the end of 2009.The hitmaker will still be allowed 50/50 custody, and even more at certain times, according to TMZ.com.

In March, Britney Spears was ordered to pay $375,000 to her ex Kevin Federline’s lawyers for representing him in their long, drawn-out custody battle for their two young boys. This came after she footed a $120,000 legal bill for K-Fed in November.
So that makes $495,000 Britney paid just to her ex husband’s legal team.

People.com: Britney Spears's lawyer said Tuesday the singer has been cleared of recent complaints to child welfare workers.
"It does not appear the county will pursue any action at this time," attorney Laura Wasser said at a hearing in Spears's custody battle with ex-husband Kevin Federline. The hearing then went into private session.
