Kelly Rutherford Battles Ex on Son's Safety Around Home Pool

All a youngster needs to hear is the words, "swimming pool," to dash in and slip into a bathing suit. For parents, an open body of water means entertaining the "what ifs" that can cause stress and panic. Even well skilled wee swimmers fall victim to tragedy in an unsupervised pool.

Gossip Girl's very pregnant Kelly Rutherford is in a battle with her estranged husband, Daniel Giersch, over pool safety at his residence. Concerned for her 2-year-old son, Hermes' safety, the actress went as far as hiring a private eye to tape her ex's home for three days to illustrate the danger his uncovered pool poses to their young son. In court documents, Giersch said:

Hermes is not in any danger whatsoever with regard to my pool because I have the pool fully covered with an automatic pool cover. Hermes has no access to the pool area unless I take him to the pool myself.

Well if he actually has an automatic pool cover, I think it's actually safer than gates as long as he actually uses it. We had one when I was a little kid and you could walk on it. I think it's also the law in most places to have a fence with a gate or doors that are alarmed around pools.

I taught kids swimming for years and there's no way I'd let my children stay/live/visit a home with an uncovered pool without a gate. Why take the chance, especially if the dad or owner has such a nonchalant attitude about it?

no! every year (in our area at least) there are a couple of drownings because kids slip by their care givers. omg, i would NEVER let my kids go to a home where a pool was uncovered and the supervision was spotty. this situation would totally freak me out. and the idea that the judge will say "now cover your pool!" and the dad will comply is unrealistic. sometimes parents have an "it won't happen to my family" attitude. it only takes a minute for a child to drown. i feel bad for the mom (and the child) if this is really happening. i'd be a nervous wreck worrying about my child the whole time he was visiting his dad if i were in this situation.
