Who Deserves Custody of These Twins?

Men and women craving parenthood often do not happen upon it naturally. For many, parenthood comes via IVF, adoption, or surrogacy. Like any birth method, there are risks associated with all forms of birthing, but surrogacy may have the most. There are five states that do not recognize surrogacy contracts, which leaves many vulnerable to losing "their" babies. Such is the case with Michigan couple Amy and Scott Kehoe.

After paying for donated eggs and sperm, the Kehoes agreed to hire surrogate Shelley Baker to be their carrier. The twin babies were born and all was well until Shelley discovered Amy Kehoe had a history of a psychiatric disorder and was a former cocaine user. While her record was certainly not clean, Mrs. Kehoe had doctors and psychiatrists who applauded her efforts and her recovery and deemed her a fit mother. Still, it was not enough for Mrs. Baker. Worried about the babies' well being, she chose to fight for their custody and won. The Kehoes believe they were wronged and that the children were kidnapped from them.

and her "crimes and mental illness" are about as innocent as crimes and mental illness can get i guess where they live adoption may be a better option

wtf i do not feel for both sides. the surrogate is a selfish b**** if she is so concerned why not monitoring or some other agreement she just wants the babies for herself i feel so bad for the parents :(

Oh man, I was so angry when I watched this on the news! Even with the social worker and lawyers saying that the Kehoes were fit parents, this woman with 4 other children who promised to carry someone elses children is the one who is more fit??? Maybe she is the one with mental problems. She gave the children to their parents and then a month later decided that they weren't fit parents? How could the court just let this go on. If the Kehoes can't have their children, Shelley needs to pay them back all of the money it took them to pay for the eggs, sperm, and all hospital bills from the pregnancy. This is just insane!

Our legal system is so messed up! The Kehoe's are the rightful "owners" of the babies because they paid for the sperm and eggs. Kelly used her uterus for profit and now is claiming ownership. The Kehoe's bought and paid for those babies--incredible that we even can say that--Kelly needs to stop being a surrogate since she has trouble letting go--so unfair, my heart goes out to the Kehoes.

well technically the babies don't belong to either of them because the sperm and eggs were donated and shelley just rented out her uterus. All in all though I think the Kehoe's have the right to those children and what she did in the past is just that in her past.

This tragedy is a result of unfair stigma and prejudice againsts persons with a mental illness diagnosis. If Amy had said she had diabetes would Shelley have taken the babies back??? Depressions and Diabetes, two chronic illness' with the potential for complications. This is a sad story. How heartbreaking for Amy to suffer 2 miscarriages and then failed IVF and then have month-long bonding with her children just to have them taken from her. My heart goes out to you Amy, and to Shelley Baker of Michigan SHAME ON YOU!!! You have children of your own, how could you do this to another Mom, one who had no hope of having her own....

I DO NOT agree with that the surrogate should have been able to just keep the babies. First off, they had a contract, nad while i understand its not legal because of surrogacy laws, it was intention to be a surrogate only. Secondly, they paid for all of her expenses throughout the pregnancy for her to turn around and just take them back after a month. Thirdly, and most importantly, the eggs and sperm were PURCHASED by the intended parents. She has no biological claim to these children - she made their birth possible by carrying them with the intention and contract to do nothing more. I think its absolutely kidnapping for her to be able to just take them away.

Don't the intended parents usually pay for medical care throughout the pregnancy? They supported the birth mom throughout her pregnancy, not to mention they paid for the donated eggs and sperm. Obviously, the doctors think that she's a fit mother. Sorry to say, Shelley, but the Kehoes are the parents.
