Virtual Grounded Terms

LEGAL POPSUGAR Grounded Virtual (the Event) is organized by PopSugar Inc. and its parent, Group Nine Media, Inc. (collectively, "Group Nine"). By registering for and/or attending the Event, you (the "Attendee") accept the Group Nine Terms and Conditions, available at https://www.groupninemedia.com/tscs, and the Group Nine Privacy Policy, available at https://www.groupninemedia.com/privacy, as acknowledged during the RSVP process. Each Attendee also agrees to follow the rules and regulations of the Event; and registration, use of login credentials/link, or attendance at the Event shall be considered acknowledgement of, and agreement to, these terms and conditions and any other terms and conditions posted on this website or at the Event.

Attendee voluntarily assumes all risks incidental to the Event, including bodily injury and death, and damage to property, whether occurring prior to, during, or following the Event. Attendee releases Group Nine Media, Inc., the virtual platforms on which the Event will occur and be live-streamed (the "Platforms"), and each of their respective subsidiaries, affiliates, officers, employees, representatives, and agents (collectively, "Releasees"), from any liability for loss or damage to persons or property, infringement of any right, or any other claims or courses of action of any kind arising from or relating to Attendees attendance of, and/or participation in, the Event, regardless of whether such loss is caused by the negligence of the Releasees.

Attendee's registration for the Event creates a revocable license for Attendee to enter the Platforms at the date and time emailed with the login credentials/link. Group Nine reserves the right to refuse entry to, or eject, any person for any reason deemed necessary in the sole discretion of Group Nine for the safe and orderly operation of the Event (including disorderly, vulgar, or abusive conduct) or for the enforcement of policies applicable to the Event (including these terms or other posted policies).

GROUP NINE RESERVES THE RIGHT TO CANCEL MULTIPLE REGISTRATIONS, FRAUDULENT REGISTRATIONS, OR REGISTRATIONS THAT OTHERWISE DO NOT COMPLY WITH THE GROUP NINE TERMS AND CONDITIONS. ARTISTS AND VENDORS ARE SUBJECT TO CHANGE. EVENT DATE AND TIME SUBJECT TO CHANGE. REGISTRATION IS NON-TRANSFERABLE AND CANNOT BE REDEEMED FOR CASH. The unauthorized resale, attempted resale, or transfer of a seat, login credentials/link, or registration to a third party is strictly prohibited and will constitute a forfeiture of the seat or registration without compensation. Each login credential may only be used by the same Attendee. The Event's date, operating hours, schedules, vendors and artists, and programming are subject to change or cancellation without notice.

Any disputes arising from or otherwise related to the Event will be governed by the laws of the State of New York. ATTENDEE HEREBY CONSENTS TO THE EXCLUSIVE PERSONAL JURISDICTION AND VENUE OF THE COURTS, STATE AND FEDERAL, HAVING JURISDICTION IN NEW YORK COUNTY, STATE OF NEW YORK.

Attendees and their representatives, agents, and affiliates are not permitted to make audio or video recordings of the Event unless expressly so authorized by Group Nine. Unauthorized recordings—including personal recordings made by Attendees and their representatives, agents, and affiliates—do not fall within the scope of consent established by these Event Terms or Group Nine's Privacy Policy. As a result, the making or dissemination of such recordings can violate federal, state, or other laws that restrict the involuntary recording of conversations.

Image and Likeness Release

Attendee hereby grants to Group Nine, its subsidiaries, affiliates, clients, and each of their respective assignees and licensees (collectively, "Affiliates"), the absolute and irrevocable right and permission to simulcast, photograph, film, reproduce, portray and/or otherwise exploit the name, voice, appearance, photograph, image and/or likeness of such Attendee at the Event (collectively, "Likeness"), and to use the results and proceeds, without limitation, in materials produced by Group Nine or its Affiliates any and all media, in perpetuity. Attendee hereby waives any claim to compensation for use of such Likeness. Attendee agrees that Group Nine owns the recordings of the Event and all rights related to them, and may use them in any manner or media without notifying Attendee, including in Group Nine's websites, social media platforms, publications, promotions, broadcasts, advertisements, and posters, for advertising or other related purposes. Attendee waives any right to inspect or approve the finished images or any printed or electronic matter that may be used with them.

Attendee releases Group Nine and its Affiliates from any claims, causes of action, damages or liability which Attendee may ever have in connection with the use of or relating to the Likeness. Attendee hereby waives any moral rights or "droits moral" Attendee may have in the material produced by Group Nine.

Attendee, or, in the event Attendee is under 18 years of age, Attendee's parent or guardian (the "Parent"), has read and understood this appearance release and hereby expressly approves and consents to this release of the Likeness, affirms their right and authority to agree to the terms, and waives all obligations and rights which such individual may have in connection therewith. For good and valuable consideration, Parent hereby guarantees that the minor or minors shall not at any time disaffirm the release of the Likeness by reason of the minor's or minors' minority or otherwise and hereby agrees to indemnify Group Nine and its Affiliates from any loss arising from any claims made by or on behalf of the minors relating to this release of the Likeness.

Age Restrictions

Please note, Group Nine recommends all individuals under 18 attend with an adult, and certain activities such as workout classes will be restricted to individuals ages 18 and up. All individuals under 13 must be accompanied by a parent or legal guardian.

Individuals under the age of 18 must obtain the permission of a parent or legal guardian before sending any information to the Event, entering any sweepstakes or contests at the Event, posting any information on the Event website or related websites, or purchasing any goods online related to the Event. The submission of information to the Event or the registration for and/or use of login credentials/link to the Event is a representation and confirmation that you are age 18 or over or have obtained the consent of a parent or legal guardian. If you are the parent or legal guardian of an Event attendee that is under the age of 18, it is your responsibility to check the suitability of the Event for any individuals in your party regardless of official age restrictions.

Cancellation Policy
Registration fees, if any, for the Event are non-refundable and login credentials/link are non-transferable and cannot be reproduced, resold or upgraded. Group Nine reserves the right to cancel the Event on limited or no notice, and in the event of such cancellation, the Attendee will not be entitled to a refund for any expenses associated with Attendee's registration or otherwise expended in connection with the Event.
